New California Regulations Take Toll on Drayage Operations

Two new regulations referred to as the ACT (Advanced Cleaned Truck) and the Advanced Clean Fleet (ACF) rule will impact decisions on buying new trucks by the end of this year, beginning with the 2024 model truck. The ACT requires manufacturers who sell MDHD vehicles to sell zero-emission vehicles as an increasing percentage of their annual sales from 2024 to 2035. The first goal is 9% by 2024 with a heavy progression to 75% in 2035. Although one regulation is manufacturer driven and the other is centric to the buyer’s market, the most impacted industry will be drayage due to the initial release of CARBS (California Air Resource Board) September phase-in of ZEV’s (largely battery-powered) beginning November 2023. 

CARB is working to develop a medium and heavy-duty zero-emission fleet regulation with the goal of achieving a zero-emission California truck and bus fleet by 2045, wherever feasible and even earlier for certain market segments such as final mile delivery and drayage. 

Stakeholders in the drayage industry have mentioned concerns about what the ACT / ACF translate to for the port drivers’ community.  FreightWaves, HTA CEO Schrap expresses concern since a switch to 100% ZEVs where only a handful are currently active would be difficult. He also exposes a potential “catastrophic failure” that despite the incentives that would be available to purchase ZEVs due to a combination of lack of charging infrastructure, a chip shortage, and a delay in receiving a new truck could leave drivers with nothing 

Not far behind California are Oregon, Washington, New York, New Jersey, and Massachusetts. Once fully adopted the 6 states will serve as pillars to major ports of entry in the nation.
